These are the general Terms and Conditions which apply to your use of the private lettings market place provided through or via our Movebee website: www.movebee.co.uk ("Platform") (the "Service").
Please read them carefully. Your use of the Service will be subject to these Terms and Conditions. By using this Service you confirm that you accept these Terms and Conditions and that you agree to comply with them. If you do not agree to these terms, you must not use the Service. If you have any questions or comments with regard to these Terms and Conditions please contact us either by email or phone.
We may change these Terms and Conditions from time to time. You should read the Terms and Conditions each time you use the Service, ensuring you are aware of the most current changes made to them.
This Service is operated by a Reach plc group company ("We" or "Us"). Important liability statement relating to the Service
Please be aware that while the Service provides a Platform whereby potential landlords wishing to rent out their properties ("Landlords") and potential tenants interested in such properties ("Tenants") can arrange viewings via a calendar, it does not provide any guarantees whatsoever regarding such viewings or properties and We do not act in any way as agents. The purpose of the Service is to facilitate and simplify private lettings by providing a Platform for allowing Landlords to showcase properties and by allowing Tenants to make direct bookings to view such properties. The Service works on the basis that any arrangements including but not limited to rental amounts, payments and contracts will be made privately between Landlord and Tenant.
Conditions of your use of the Service
You may use the Service for your own personal use only and this use must be in accordance with these Terms and Conditions.
You must only use the Service and anything available as part of the Service for lawful purposes, and you must comply with all applicable laws, statutes and regulations.
Except to the extent expressly set out in these Terms and Conditions, you are not allowed to make any copies of any part of the Service.
You are not allowed to remove or change any copyright, trade mark or other intellectual property right notices contained in any material that comprises part of the Service, or from any material copied or printed off as part of your use of the Service.
Landlords must only use the Platform to list a property if the Landlord has the right to offer the property for rental and will not breach any law, agreement or contract by doing so, which includes the terms of any mortgage on the property and any insurance contract.
The Role of Drag and Drop and how they, We and others involved in providing the Service to you may use your data
We use a company called Drag & Drop Limited (www.draganddrop.co.uk). They provide Us with the property listing Platform We use. In using the Service, Drag and Drop will hold your data on their Platform. Drag and Drop may be able to access your data, but this will only be for administration purposes (in relation to the Platform) and they will not use your data for any other purpose.
We may disclose personal information if required to do so by law or if We believe that such action is necessary to protect and defend the rights, property or personal safety of the Service or its user.
Intellectual Property Rights
All copyright, trademarks and other intellectual property rights in all material and content contained within the Service is either owned by Us or has been licensed to Us by the rights owners so that We can use this material as part of the Service.
Disclaimer and Limitation of Liability
We do not, and nothing in these Terms and Conditions shall act to, exclude or limit our liability for death or personal injury resulting from our negligence, fraud or any other liability which may not by applicable law be excluded or limited. Your statutory rights as a consumer are not affected by any of these Terms and Conditions.
We do not act in any way as an agent and, for the avoidance of doubt, We do not arrange viewings, payment, contracts or any other arrangements on behalf of or for the Landlord or Tenant.
You acknowledge and agree that any rooms, flats, houses, properties or tenancy arrangements are not provided by Us. We have no control over, nor accept any responsibility or liability for, any such arrangements or issues you may encounter with them.
We do not inspect any of the properties or rooms that feature in adverts on our Platform. We strongly advise you to inspect properties thoroughly before you make any binding commitments in respect of any properties or rooms listed on our Platform.
The information made available on the Platform, whether posted by Us or by any other users, is provided for information purposes only. We cannot guarantee that any adverts or other information provided on the Platform will be correct, accurate, up to date or meet your needs or requirements. The information provided on the Platform is not intended to be professional or legal advice of any kind and should not be relied on as such. Any reliance you place on any materials or information made available on the Platform is entirely at your own risk.
We make no warranties, whether express or implied in relation to the accuracy of the Service. We specifically cannot and do not warrant or guarantee the accuracy of the content on the Platform posted by the Landlord, including any descriptions or photographs, or any representations whether written or oral made by the Tenant and Landlord. The Service is provided for you to arrange property viewings only and We shall not be liable to you or any third party for any losses you or anyone else suffers as a result of relying on the representations made through the Service. This includes not being liable for (a) any indirect loss, claim or damage, or any punitive, special, incidental or consequential damages of any kind; or (b) any direct or indirect loss of profit, anticipated savings, opportunity or business and loss, corruption or damage to data, in each case whether based in contract, tort (including negligence), strict liability, or otherwise, which arises out of or is in any way connected with (i) any use of this Platform or the Services provided through it; (ii) any failure or delay in the use of any component of the Platform or any Service including, without limitation, any unavailability of the Platform or the Services provided through it irrespective of the duration of any period of unavailability; (iii) any use of or reliance upon any adverts, information, material, or other products or the Services offered through the Platform, in all cases even if We have been forewarned of the possibility of such loss or damage; and (iv) any tenancy or lodging arrangements of any kind that you enter into as a result of using our Platform. We cannot and do not guarantee that the Service will be constantly available or error-free.
Subject to the two paragraphs set out above, our liability to you whether in contract, tort or otherwise is limited to £100.
You agree that your use of the Service is on an "as is" and "as available" basis and that your use of the Service (and your reliance on any valuations or other information available through the Service) is at your sole risk.
We reserve the right to withdraw or discontinue any product or service at any time at our sole discretion.
WE DO NOT EXCLUDE OR LIMIT OUR LIABILITY FOR ANYTHING WE ARE NOT ALLOWED TO AND YOUR STATUTORY RIGHTS AS A CONSUMER ARE NOT AFFECTED BY ANY OF THESE TERMS AND CONDITIONS.
General and Governing Law
These Terms and Conditions form the entire understanding between Us and you and supersede all previous agreements, understandings and representations relating to the subject matter. If any provision of these Terms and Conditions is found to be unenforceable, this shall not affect the validity of any other provision. Both of Us may delay enforcing our rights under these Terms and Conditions without losing them.
We will not be liable to you for any breach of these Terms and Conditions which arises because of any circumstances which We cannot reasonably be expected to control.
No part of these Terms and Conditions may be enforced by any person other than Us and you.
These Terms and Conditions shall be governed and interpreted in accordance with English law, and you consent to the exclusive jurisdiction of the English courts.
